A completed “Vacation Rental Guest Agreement” is required within 24-hours, and once received your booking is confirmed. When booking on a 3rd party listing site, that 3rd party shall be the merchant of record for all bookings made through that third party. See third party site for payment options and details. Third party cancellation policy will apply.
Payment:Tahoe Alpenglow Properties (TAP) accepts Visa, Mastercard, and American Express. Payment is due 30 days prior to arrival. The total of your stay includes Rent, Transient Occupancy Tax, Cleaning Fee, Booking Service, and possibly a Pet Fee and/or Hot Tub Service Fee (if applicable), as well as either a $3,000 deposit, OR a $49 Damage Protection Insurance plan with a policy limit of up to $3,000 in coverage.
Cancellation Policy:If you cancel the reservation outside of 30 days prior to arrival, the initial 25% payment will be retained by TAP as is considered a NON-REFUNDABLE reservation fee for services rendered in entering into this Agreement. A cancellation at 30 days prior to arrival or less will result in a forfeiture of entire contract amount. TAP strictly enforces this policy and no exception will be made whatsoever. Notice of cancellation must be received in writing. We do not offer refunds for poor or severe weather conditions, late arrivals, early departures, travel conditions, road closures, allergies, health or medical issues, utility or water outages, mandatory evacuation, terrorism, construction at neighboring properties, disruption of utility services or other reasons outside the TAP’s control. We strongly urge you to purchase the optional Vacation Rental Travel Insurance at the cost of 6.95% of your stay for similar coverages.
Check-In: Check-in time is 4pm. This time may be flexible depending on the reservation schedule of a particular property and you may request an early check-in and be charged an early check-in fee of $25-$50 per hour that will vary depending on arrival time and home. Check-in information, property address and other information along with the lock box code will be sent to you 1 week prior to check-in date, and only when paid in full. Keys will be located in a lockbox at the property and must be returned to the lock box at departure.
Check-out: Check-out time is 11am. You may request a late check-out and be charged a late check-out fee of $25-$50 per hour that will vary depending on departure time and home. Late Check-Outs must be pre-approved by TAP, otherwise unauthorized late check-outs will be subject to a minimum fee of $100 plus $50 per hour past 11am and will vary depending on time of departure. All keys MUST be returned to the lock box. There will be a $150 re-keying fee if all keys, remotes, access cards and HOA cards are not returned. Please follow the Departure Check List prior to leaving the property to avoid any additional fees, including but not limited to the above or extraordinary cleaning fees.
Damage Insurance:As a part of your stay, you may already have our $49 Vacation Rental Damage Protection plan designed to cover unintentional damages to the rental unit interior that occur during your stay, provided they are disclosed to management prior to check-out. If purchased, the policy will pay a maximum benefit up to the $3,000 shown on the confirmation. Any damages that exceed the $3,000 or are not covered under the plan will be charged to the credit card on file. If, during your stay at one of our rental properties, an insured person causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to a maximum benefit of the policy limit. Certain terms and conditions apply. Full details of the Vacation Rental Damage coverage are contained in the Description of Coverage or Insurance Policy www.vacationrentalinsurance.com/g20vrd. The Vacation Rental Damage plan can be purchased up to, and including at, check-in. By submitting payment for this plan, you authorize and request CSA Travel Protection and Insurance Services to pay directly Tahoe Alpenglow Properties any amount payable under the terms and conditions of the Vacation Rental Damage. Please contact Tahoe Alpenglow Properties directly if you do not wish to participate in this assignment, and prefer to pay a $3,000 deposit.
Deposit / Damage Insurance:Guest must pay either a $3,000 deposit, or $49 Vacation Rental Damage Insurance. Either the Damage Protection Insurance (included at check-out) or the $3,000 deposit was due at the time of booking. This insurance is not mandatory, and if declined by Guest, a separate $3,000 deposit will be collected at time of booking. If Guests declines our $49 Damage Protection Insurance, their $3,000 deposit will be used to cover any and all incidentals, damages or extraordinary cleaning costs that may occur during your stay, at cost. When purchased, Tahoe Alpenglow Properties cannot be held liable for decisions made by insurance agency, or for the amount of time it takes for the insurer to process a claim. When damages are disclosed, Tahoe Alpenglow Properties will file a claim on your behalf, and in order for our claim to be completed, you MUST cooperate with the insurance agency who will attempt to contact you. If you do not confirm your stay and describe said damages with the insurance agency, they cannot complete the claim and Tahoe Alpenglow Properties will be forced to charge your credit card on file, at actual cost of damages. The entire Premises will be inspected for any damages before your arrival and after your departure, and if any are found after your departure without previously being mentioned by you, your credit card on file will be charged accordingly. Any deductions taken from the deposit will be handled within 21 days of departure and a full accounting along with any refund shall be returned to the Guest within that time frame. In the event of a dispute, settlements are to be heard in the jurisdiction where the property exists.
CSA Travel Insurance:Vacation Rental Travel Insurance has been made available with your reservation. Vacation Rental Travel Insurance provides coverage for prepaid, nonrefundable expenses due to certain unforeseeable circumstances that may jeopardize your vacation investment and force you to incur unplanned expenses. We strongly recommend you purchase this valuable protection. Separate terms and conditions apply, read your Description of Coverage/Policy carefully and contact CSA at (866) 999-4018with coverage questions.
House Rules & Regulations: Many of our homeowners have rules that are specific to their home only. Please read all provided documents after booking, including the Check In/Out Instructions & the Guest Welcome Binder in the home, and abide by posted rules within the home. The property being rented is in a residential neighborhood with year-round residents living nearby. Parties, excessive noise, rowdy behavior, and other nuisances will not be tolerated. Guest is entitled to the quiet enjoyment of the home and TAP will not interfere with that right as long as Guests do not interfere with those rights of the neighbors and other Guests. Any complaints from neighbors may result in immediate eviction without refund. Furnishings should not be moved. If you do move any furnishing, return them to the original location upon departure to avoid a $100 fee to relocate the items. This includes anything inside and outside of the Premises, and BBQ and grills. If property is a condominium, or part of an HOA (Tahoe Donner / Boulders) Guest agrees to abide by all rules in accordance including but not limited to parking, odors, trash and use of common areas. Any violation of these rules, or for an unauthorized use, or if destroyed will result in unilateral termination and be deemed a breach of contract leading to eviction, and all payments and security deposits will be forfeited.
If Booking Truckee Home in Tahoe Donner: All guest should be made aware of Tahoe Donner Home Owner Association Rules and Regulations, which can be found at http://www.tahoedonner.com/members/homeowner-guidelines/covenants/. All fines charged to TAP by Tahoe Donner HOA, including but not limited to: exterior lights left on after 10PM, 10PM Noise Ordinance, Parking Restrictions, Occupancy Limitations, etc; will be passed through to and will be the responsibility of Guest when applicable, and ultimately decided by TAP. Please also be aware of Active Fire Bans, and Emergency Evacuation Routes shown at http://www.tahoedonner.com/members/member-news-info/community-safety-emergency-preparedness/. Some of this info will be contained within the Guest Welcome Binder provided in Home.
Illegal Activity:The Guests shall only use the Premises as a residence, and no illegal activity shall take place in our around the Premises. Guests will comply with all laws, statutes, rules and ordinances regarding the use of the premises which include but are not limited to underage drinking, vandalism, or use of illegal substances. If illegal activity is discovered during your stay you may be evicted immediately and all payments and security deposits will be forfeited.
Occupancy: All homes have a maximum occupancy specified in the listing. If at any time the number of guests (children and adults) exceeds the maximum occupancy, your credit card on file will be charged an additional $50 per person per day and since you are in breach of contract you may be evicted immediately without refund. In the event of an eviction, all payments and security deposits will be forfeited. No Business or Private Events or Parties are allowed in any of our homes.
Amenities: Our homes are equipped with basic kitchen utensils, small appliances, towels, bedding and basic toiletries unless specifically stated otherwise in the home description. Kitchens are well equipped with dishes, glasses and tableware for the maximum occupancy. We do suggest bringing extra toiletries, bath soaps and other comfort essentials. Towels for beach, pool or spa may be included. If you require something specific, please contact TAP so we may attempt to further assist you. Firewood may or may not be provided for Guest use (See Check-In/Out Instructions which are emailed 1 week prior to arrival and posted in home within Guest Welcome Binder). Place all remaining embers in the metal bucket provided and NOT in the trash as they remain very hot for a long period of time and are a fire hazard. Most of our homes provide some form of television service, whether it be satellite/cable television, or provided Netflix and/or Hulu, and WIFI. TAP or Owner is not responsible for power outages, equipment, or service failures during your stay. If a malfunction does occur, please report to TAP immediately so we may send someone for repair as soon as possible. Refunds will not be given for lack of these services or for regular maintenance that may occur during your stay. TAP expresses no guarantees, expressed or implied, regarding suitability or fit ability to Guest individual tastes. Some listed amenities may not be available seasonally such as community pools or hot tubs, tennis courts or even decks, grills, or patio furniture, mostly due to Winter conditions. TAP cannot guarantee amenities provided through homeowner associations, including but not limited to beach facilities, picnic areas, clubhouses, tennis courts, golf, hot tubs and pools. Please inquire about availability during your stay.
Hot Tub: If the Premises has a hot tub, it will be serviced prior to your arrival. Be sure to follow all rules and safety guidelines when in use. If excessive use, abuse or neglect occurs the hot tub will require a Dump and Scrub service and your credit card on file will be charged accordingly, or the funds will be deducted from your traditional deposit. Neither TAP nor the Owner of the home you are renting accepts responsibility for the use of the hot tub by persons renting this home or their guests. The undersigned accepts and assumes all risks involved relating to the use of the hot tub, deck, and patio areas.
Cleaning and Damages: Guest acknowledges that the home is in good order unless otherwise indicated within one hour of check-in. Home is expected to be in the same condition upon departure, as it was when you arrived. House cleaning is a required service after all departures and is included in the cost of your reservation. If excessive cleaning is required, Guest is held liable for extra charges as they are NOT part of your Damage Protection Insurance plan. Charges vary depending on hours and supplies needed to clean, and costs will be deducted from either your credit card on file OR deposit. Damages include but are not limited to stains as well as damage to or loss of property. Guest is expected to run the dishwasher, strip the bedding, collect used towels, start a load of laundry, and place excess garbage into the bear box at departure.
Trash/Bears: Trash should NEVER be left outside of the bear box to avoid unwanted visits from wild animals in the area which may cause danger to Animal, Guest, or Premises. Trash should be left inside, locked in the bear box, or as a last resort in the garage if there is no bear box at your property. Please call TAP for additional trash pickup if necessary. Additional fees for extra trash pickup will be $45 plus the additional dump fees which will be assessed at the dump. The Bear Box has a (1) or (2) can minimum (depending on home), and any trash that does not fit in the bear box is considered excessive trash.
Heat/Utilities:DO NOT TURN HEAT OFF DURING WINTER (October - April).There is a large risk of pipes freezing and the Guest will be held responsible for negligence. Please make sure all doors and windows are closed during Winter months, and please be considerate of your heat, water and electricity usage during your stay. Please set heat to a comfortable temperature during your stay, but when home is vacant, turn fireplace off and set away heat to 50° unless otherwise posted. During Summer months, be aware that it is not common for any homes in the greater Tahoe area to have air conditioning. Please DO NOT set the thermostat to "COOL" as this will not do anything, and please keep the FAN set at "Auto". We prefer having the thermostat "OFF" during the Summer months. Simply open all windows at night, close them in the morning, and you may have provided fans in Home.
Area Conditions: It is your responsibility to research Tahoe Donner HOA Rules & Regulations, the neighborhood and surrounding areas, to prepare yourself for incidences that may occur during your stay (For Example: Bear Encounters). TAP is not responsible for providing all information regarding wildlife (Bears, raccoons, bees, rodents, etc.), weather, or area conditions (snow, dry climate, temperature, high altitudes, traffic, etc.).
Locked Areas: Any doors, cabinets, or storage areas that are locked are to be considered off limits. These areas are designated as the Owner’s personal space and Guests are NOT permitted to enter. Any attempt to enter these areas is cause for immediate eviction, and all payments and security deposits will be forfeited. Guest will be held liable for any damage and/or missing items.
Pets: If you plan to bring a Pet, please select the Pet Fee at check-out, and you must bring a kennel to prevent the Pet from roaming our Home unattended. Pets are only allowed at Pet Friendly properties and if you have received permission by TAP to bring a pet to the rental property. Pets will incur a pet fee which varies depending on Home. Pets are not allowed in or around a No Pets property. Please respect this rule as it may apply for reasons such as Owner allergies. Adversely, Owners may still have had pets in their home that we are renting to you as a no pet home. For this reason, please advise us to any allergies you may have. If a pet is discovered at a No Pets property, your party will be asked to vacate the property immediately, all payments and security deposits will be forfeited, a $150 minimum fee for additional cleaning (carpets, bedding, furnishings) will be deducted from your credit card on file or deposit as necessary. Service animals may be permitted with proper paperwork submitted to TAP in advance but additional cleaning fee may still be required if deemed necessary after departure.
Smoking:ALL PROPERTIES ARE NON-SMOKING. Thank you for NOT smoking. Smoking is not allowed in or around properties which includes but is not limited to driveway, patios, garages, yards and decks. If it is discovered that there has been smoking in or around the Premises, additional cleaning fees may be added on top of a definite $150 FINE.
Telephones: Most of our homes have landline phones. These phones may be used for local calls only, and any long distance calls should be paid for with a calling card, collect call or by use of your cell phones. Any long distance charges will be charged to the guest as well as a $25 processing fee.
Parking:STREET PARKING IS NOT ALLOWED FROM NOVEMBER 1 TO MAY 1 DUE TO COUNTY SNOW REMOVAL. Please park in designated parking areas or you may be cited, towed by the county, or even pushed aside by a snow plow... All of which will be the responsibility of Guest.
Snow Removal: Snow removal is provided November through April for each property, however, TAP does not control snow removal operators. Your driveway will be plowed once in a 24 hour period when snowfall is greater than 6”. Snow shovels and ice melt may be provided at each property, and the Guest will be responsible for shoveling walkways, entrances and decks during their stay. If assistance is needed, contact TAP and additional snow removal services may be arranged at Guest expense. Note: Your Driveway Cannot Get Plowed With Your Car In It. Maintenance: TAP will try to address any maintenance issues to the best of our ability as they arise. Even though each home is cleaned and inspected prior to guest arrival, we may miss something or something may malfunction between our inspection and your stay, or during your stay. If a malfunction does occur, please report to TAP immediately so we may send someone for repair as soon as possible. It is the responsibility of the Guest to immediately notify TAP of any issues that occur during their stay so that the repair and/or replacement may be promptly taken care of. If Guest does not notify TAP of any defect that may arise after taking possession of the Premises, Guest will be liable for any injury resulting from the defect. TAP does not guarantee that appropriate repair and/or replacement will be performed timely under prevailing circumstances. TAP is not responsible for any inconveniences for which TAP has no immediate control. In extreme circumstances, TAP emergency line may be used by calling 408-656-3701, otherwise Please respect normal business hours of Monday through Saturday 8:30AM-5PM, and Sundays 9AM-4PM. If an issue occurs than cannot be fixed in a reasonable amount of time and significantly disrupts Guests stay, TAP reserves the right to refund at their discretion or relocate Guest to a comparable home.
Guest Responsibilities:Conduct yourselves in such a manner as to ensure the peaceful enjoyment of the neighborhood (Guests of the Guest entering this agreement have the same obligation); to not tamper with or remove a properly working smoke detector; to keep premises clean and free from debris, filth, rubbish, and garbage; to remove and dispose of all waste and garbage from premises and into bear box in a clean and safe manner; to use the premises in a reasonable manner and in accordance with the intended use; to keep all plumbing fixtures as clean as their use permits; to use all systems and components of the premises (including but not limited to appliances, heating, electrical, laundry facilities) in a reasonable manner and not abuse them; to not abuse or deliberately destroy, damage, or remove any part of the premises.
TAP Entry: Owner, TAP, and representatives, reserve the right to enter the Premises with prior reasonable notice to confirm compliance with Guest responsibilities and the terms of this Agreement. TAP reserves all rights to enter the property during occupancy when there is a breach of the Guest Agreement such as but not limited to, excessive noise, neighbor complaints, smoking, unlawful activity, exceeding maximum occupancy, etc.
Return of Items Left: Notify TAP immediately if you have forgotten any personal items in the home and we will do our best to retrieve them for you. Owner, TAP or representatives are not responsible for lost or stolen items. Upon retrieving the forgotten item, we will return item to you by regular postal service for a minimum fee of $35 to cover postage and reasonable storage costs. You will be asked for payment prior to the return of item(s). According to CA Civil Code §1983, Guest will have 15 days to claim property after we inform you by phone or email.
Liability/Injury/Indemnification:Individual contracting this Agreement is responsible for ALL Guest(s) actions in or around Premises. ALL Guest(s) are expressly assuming the risk of any harm arising from their use of the Premises. Neither TAP nor Owner shall be held liable, or otherwise take any responsibility for any accidents, injury, illness or damage to Guest(s) on or around the Premises or in available facilities that is caused by intentional, unintentional, negligent, or careless acts of said Guest(s). You as Guest, on behalf of yourself, your Guests, and all successors, assigns and heirs, hereby agree to protect, defend, indemnify and hold harmless the property Owner and Tahoe Alpenglow Properties, employees, or representatives thereof, from and against any and all loss, damage, costs, expense or liability (including reasonable attorney fees) arising out of any accident or occurrence on the Premises or any common area causing injury to any person or property, no matter how caused. By the written or electronic endorsement of the Agreement, Guest agrees to forever hold-harmless and indemnify TAP from any liability and/or responsibility arising there from. Tahoe Alpenglow Properties is not held liable for any negligence or unlawful acts of the Owner.
Assumption of Risk: TAP is acting as Property Manager solely for the Property Owner and your Guest Agreement is a binding contract between you and the Property Owner. If this contract is breached in any way, the Transient Occupants (Guests) may be evicted immediately from the Premises and all payments and security deposits will be forfeited. By signing the rental agreement, you warrant that you are legally capable and authorized to make charges to the account. The laws of the State of California shall govern this contract. Any legal action shall take place in the County in which the Property is located.
Mediation: Before any formal alternative, Guest agrees to mediate any dispute, claim, or transaction arising between them. No authority to make a decision or impose a settlement upon the parties is given the mediator, however, a Memorandum of Agreement once signed by both parties is binding and enforceable. If any party commences arbitration without first attempting to resolve through mediation, that party shall not be entitled to recover attorney’s fees even if they otherwise would have been available to that party in arbitration or court action in any such action. The parties agree that the venue for mediation arising out of this contract shall be the County of Nevada, Truckee Branch. This mediation provision applies whether or not Guest notifies TAP in writing that they wish not to Arbitrate.
Arbitration of Disputes: The Parties agree that any dispute or claim in law or equity arising between them under this contract or any resulting transaction, which is not settled through mediation, shall be decided by neutral, binding arbitration. The arbitrator shall be a retired judge or justice, or an attorney with at least five years of residential experience, unless the parties mutually agree to a different arbitrator, who shall render an award in accordance with substantive California Law. In all other respects, the arbitration shall be conducted in accordance with Part III, Title 9 of the California Code of Civil Procedure. The parties shall have the right to discovery in accordance with Code of Civil Procedure §1283.05. The parties agree that the venue for arbitration arising out of this contract shall be the County of Nevada, Truckee Branch. Judgment upon the award of the arbitrator(s) may be entered in any appropriate court having jurisdiction.
NOTICE: BY EXECUTING THIS AGREEMENT EITHER IN WRITING OR ELECTRONIC ENDORSEMENT YOU ARE AGREEING TO HAVE ANY DISPUTE ARISING OUT OF THE MATTERS INCLUDED IN THE ‘ARBITRATION OF DISPUTES’ PROVISION DECIDED BY NEUTRAL ARBITRATION AS PROVIDED BY CALIFORNIA LAW AND YOU ARE GIVING UP ANY RIGHTS YOU MIGHT POSSESS TO HAVE THE DISPUTE LITIGATED IN A COURT OR JURY TRIAL. YOU ARE GIVING UP YOUR JUDICIAL RIGHTS TO DISCOVERY AND APPEAL, UNLESS THOSE RIGHTS ARE SPECIFICALLY INCLUDED IN THE ‘ARBITRATION OF DISPUTES’ PROVISION. IF YOU REFUSE TO SUBMIT TO ARBITRATION AFTER AGREEING TO THIS PROVISION, YOU MAY BE COMPELLED TO ARBITRATE UNDER THE AUTHORITY OF THE CALIFORNIA CODE OF CIVIL PROCEDURE. YOUR AGREEMENT TO THIS ARBITRATION PROVISION IS VOLUNTARY. PLEASE NOTIFY TAP IN WRITING IF YOU WISH TO NOT ARBITRATE.
Entire Contract: All prior agreements between Owner and Guest are incorporated in this Agreement, which constitutes the entire contract. It is intended as a final expression of the parties’ agreement and may not be contradicted by evidence of any prior agreement or contemporaneous oral agreement. Any provision of this agreement that is held to be invalid shall not affect the validity or enforcement of any other provision in this agreement. UPON WRITTEN OR ELECTRONIC ENDORSEMENT, GUESTS AGREE THAT THEY HAVE READ AND UNDERSTOOD THIS AGREEMENT, AND ACCEPT ALL TERMS, CONDITIONS, COVENANTS AND RESTRICTIONS, WITHOUT EXCEPTION.
Tahoe Alpenglow Properties respects the privacy of anyone who uses our website and/or books our properties. We only process and use the data obtained for the specific purposes you have authorized during your transaction, the above mentioned, and to inform you of future rental promotions. We do not sell customer information to any third parties.
